BUSINESS LITIGATION AND CLASS ACTIONS

A free market means that America is the land of opportunity. However, achieving success as a business in today’s economy is hard. Sometimes a good company struggles even more because of unfair competition, breach of contract, hidden fees, overcharges, and plain old fraud. These are only a few of the ways big companies can drive small businesses out of business. At CBPW we expose the fraud and make sure the market really is open, fair and free for everyone.

Often, these cases take the form of class actions where we represent hundreds or even thousands of small businesses against a big business. Sometimes we represent employees or officers inside big business with the courage to blow the whistle on Medicaid Fraud or other illegal practices.

We have used our courtroom experience in the areas of Antitrust and Unfair Competition, Business Fraud, Breach of Contracts, Business Interference, Securities and Shareholder Losses to champion the cause of those who make up the backbone of Main Street America.

Taking the fight to them. At CBPW, we have a statewide and national practice. We have litigated cases from Kansas City to Cape Girardeau and from Arizona to Philadelphia. We are at home in the federal courts, the Courts of Appeals and the state court systems.

Some current cases include:

- Speaks vs. NPS et al (lead counsel for a national class of funeral homes defrauded by preneed funeral company)

- Maevers v. Allied Waste Co. (co-lead a national class in breach of contract -overcharges )

- Burks v. White River Electric Coop (lead counsel statewide class with claims for unlawful retention of capital credits owed to members and business)

American Red Cross

In our practice, we hear the stories our clients tell about their injuries, their surgeries and their fight to recover. We have witnessed how a natural disaster can shatter lives. Whether the need is from a natural disaster or a serious injury, blood is always in short supply. That’s why, as a firm, we regularly give blood to the American Red Cross. Our partner, John Cook has given over 10 gallons!
